TERMS AND CONDITIONS FOR THE NEWSLETTER SERVICE
 
 
I. General provisions
 
The Terms and Conditions set out the rules for the provision and use of the Newsletter service electronically.
The operator of the service is:

In order to use the Newsletter service, it is necessary to have a device such as a computer/tablet/smartphone with an installed operating system and Internet browser, access to the Internet and an active electronic mail address (e-mail).

II. Subject of the Newsletter service
 
The Newsletter service (hereinafter: Newsletter), consists of sending information electronically by Brodziak Gallery to the e-mail address provided by the recipient about offers, promotions, services, competitions, events, and collections available in the stationary Brodziak Gallery Poznań/Warsaw shop and on szymonbrodziak.com
The newsletter is sent periodically.
 
 
III. Terms and conditions for using the Newsletter
 
The newsletter is sent free of charge once all the steps described below have been completed.
The condition for using the Newsletter is to order the service by:
to be familiar with the content of these Rules;
correct entry in the indicated form marked “Newsletter” on the website szymonbrodziak.com, of your electronic mail address (e-mail) and confirming it with the “Subscribe” button.
When signing up for the Newsletter, you are required to provide your own active e-mail address.
Once the above steps have been completed, Brodziak Gallery will automatically send a return email to the email address provided containing an activation link: “I confirm subscription”, which must be clicked to activate the service.
The conclusion of the agreement for sending the Newsletter takes place after activating the link contained in the return message sent by Brodziak Gallery.
Provision of an e-mail address and activation of the service constitutes agreement to receive the Newsletter and acceptance of these Terms and Conditions.
As soon as the subscription is confirmed, Brodziak Gallery will start providing the Newsletter service.
Individual messages, sent as part of the Newsletter service, constitute works within the meaning of copyright law and are subject to protection as defined by law. Any copying, modification and use in a manner inconsistent with the intended use or without the consent of Brodziak Gallery may constitute an infringement of the law.
 
 
IV. Duration of the Newsletter service
 
The Newsletter service contract is concluded for an indefinite period of time from the moment the Newsletter is activated (clicking on the activation link), until the user withdraws consent.
The user has the right to terminate the Newsletter contract at any time.
You can unsubscribe from the Newsletter at any time, without giving any reason for the unsubscription.
If the user unsubscribes from the Newsletter via the unsubscribe hyperlink in the Newsletter, the termination shall have immediate effect.
The Newsletter service contract can also be terminated by: directing an appropriate declaration of cancellation to the e-mail address: laura@szymonbrodziak.com. In such cases, the Newsletter service agreement is terminated within 30 days from the date of receipt by Brodziak Gallery of the relevant notification.
Brodziak Gallery has the right to delete an incorrect or non-existent email address provided by the customer.
 
 
V. Processing of personal data
 
Brodziak Gallery makes every effort to ensure that all physical, technical and organisational measures are in place to protect personal data against accidental or wilful destruction, accidental loss, alteration, unauthorised disclosure, use or access, in accordance with all applicable legislation.

Co-administration takes place under the regulations arising from Article 26(1) of the RODO (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC – General Data Protection Regulation), and is caused by the fact that these entities jointly determine the purposes and means of processing your data.
The controller has appointed a Data Protection Officer who can be contacted on all matters relating to the processing of personal data by sending an email to laura@szymonbrodziak.com.
We process the personal data of all subscribers in connection with their consent to the sending of the Newsletter (the legal basis for the processing is Article 6(1)(a) RODO), in which we inform you about the current commercial offer and events taking place in our stationary galleries and online.
Subscribers’ personal data will also be processed for the purpose of establishing, defending and asserting claims for the duration of the service, i.e. until consent is withdrawn, within the limits of the Administrator’s legitimate interest (the legal basis for processing is Article 6(1)(f) RODO). In addition, we process data for evidential purposes (the granting of consent or its withdrawal or doubts regarding the correct implementation of a request within the scope of the RODO).
The controller will process the following categories of subscribers’ personal data: e-mail address.
The personal data of Newsletter subscribers will be made available to other data recipients only in cases provided for by law (if necessary) or on the basis of agreements on the entrustment of personal data processing to entities cooperating with the Administrator. These entities provide us with services in the field of: IT maintenance. These activities relate, for example, to marketing activities, to entities providing IT or maintenance services, which will process the data with the consent and on the express instructions of the Controller.
The personal data provided will be stored until the withdrawal of consent (which means the termination of the service and the termination of the contract) and until the statute of limitations for claims arising therefrom. After these periods, data will only be stored for the time required by law.
Subscribers’ personal data are not transferred to recipients in third countries, i.e. outside the European Economic Area (EEA) or to international organisations.
We ensure that the persons whose personal data we process exercise their rights under the law, including the right to access the content of their own personal data, to rectify, amend, delete or transfer them, as well as the right to request restriction of the processing of personal data and to object to such processing under the terms of the relevant legislation. Each person whose data is processed also has the right to lodge a complaint with the President of the Office for Personal Data Protection, Stawki 2, 00-193 Warsaw, if he/she believes that his/her personal data is being processed unlawfully.
Provision of personal data is voluntary, but necessary to provide the service, i.e. to receive the Newsletter.
Personal Data will be processed by automated means and may be processed for marketing purposes (including necessary analytics, compilation into marketing profiles) so as to provide you with an offer tailored to your needs and preferences, to which you may object.
The User’s personal data is processed for the purpose of concluding and performing the contract for the provision of digital content in the form of Materials on the basis of Article 6(1)(b) of the RODO. Once the Materials have been provided, the User’s personal data is stored in the Administrator’s database for archival purposes, for the possible defence, establishment or assertion of claims related to the contract, which constitutes a legitimate interest pursued by the Administrator referred to in Article 6(1)(f) RODO. The data will be deleted after the expiry of the limitation period for claims related to the contract.The User’s personal data are also processed for the purpose of Newsletter service, i.e. sending e-mails, analysis of statistics related to the messages sent, segmentation of the base. On the basis of the segmentation performed by the Administrator, the User may end up in different groups of Newsletter recipients, which have an impact on the scope and content of the content sent within the Newsletter. The User may always request from the Administrator information on affiliation to particular groups and their expected modification in the scope of such affiliation.

VI. Complaints and other information
 
Complaints about the Newsletter service should be submitted to the email address laura@szymonbrodziak.com.
When lodging a complaint, the data of the person lodging the complaint should be provided, as well as a description of what the irregularities or problems with the Newsletter service consisted of and what is expected from the resolution of the complaint.
Complaints will be answered within 14 days of receipt of the complaint, by e-mail to the address from which the complaint was received.
Brodziak Gallery reserves the right to amend these Terms and Conditions to the extent permitted by law. In this case, Brodziak Gallery will inform about the planned changes adequately in advance on its website. Amendments to the Regulations will not affect the rights already acquired by users and will not deteriorate the terms of the Newsletter.
Each time the Terms and Conditions are amended, the subscriber will be informed of the new version.
